In order to get divorced in British Columbia, you need a judge of the Supreme Court to sign a divorce order.  However, if you and your ex-spouse have agreed on the other aspects of the separation, you can get a divorce without ever having to step foot in court through an uncontested divorce.   

What is an Uncontested Divorce?

An uncontested divorce (also called a desk order divorce) is the process of obtaining a divorce when both parties are in agreement on the other aspects of the separation such as parenting issues, child and spousal support, and property division, or when the other issues have been dealt with by separate order.  

Why do I need to get legally divorced?

Obtaining a divorce order is important to achieve finality.  Until the divorce order has been signed, you are legally married.  Even if you have been separated for years, your spouse may still have a legal claim for property division, spousal support, or pension division if those issues have not been finally dealt with.  

Once a divorce order is entered, you and your ex-spouse have 2 years from the date of the divorce to pursue any claims arising from the relationship.  Once the limitations period is expired, no further claims can be brought.
