Often, determining issues relating to Children are the most difficult and contentious issues that come from a separation or divorce.  The law is clear that the only consideration in decisions respecting children is what is in the best interests of the child.  Unfortunately, parents will disagree on what that may mean for their particular child(ren).      

Guardians must make important decisions about the time each parent spends with the child(ren) (known as parenting time) and the decisions that must be made for the child(ren) (known as parental responsibilities).  If the guardians do not agree, it is important to have an experienced family lawyer who can help you understand the factors that a judge may consider in determining those issues.

Parenting After Separation

In British Columbia you must complete the Parenting After Separation course before you can go to the Provincial Court to obtain or change an existing order about guardianship, parenting arrangements, contact or support.  The course is provided provided by the government of British Columbia free of charge.  You can gain access to the course here:  Parenting After Separation – Province of British Columbia (jibc.ca)
